Compulsory Purchase and Compensation

The use of Compulsory Purchase Orders by Local and other Statutory Authorities is increasing in order to assemble sites for development and regeneration.

It is an area of practice where we have extensive experience and knowledge which is vital in an area which is governed extensively by statute and case law.

We act for both Acquiring Authorities and claimants.

On behalf of Acquiring Authorities, we provide advice from inception in connection with budgetary costings, negotiations, preparation of the Compulsory Purchase Order and as Expert Witnesses at Public Inquiries. We also deal with the implementation of the Compulsory Purchase Order, once confirmed, in often delicate negotiations with claimants.

On behalf of claimants, we seek to protect their interests and to optimise their positions through negotiations with Acquiring Authorities to ensure that their compensation claims are properly and fully completed.

This is a very specialised area of practice where we have represented the following:

  • Greater Manchester Passenger Transport Executive - In connection with Phases 2, 2A and 3 of Metrolink.
  • Bury MBC/Thornfield Properties Plc - In connection with the assembly of the 22 acre regeneration site in Bury town centre (see Case Study).
  • Trafford MBC - In the creation of a Quality Bus Corridor and associated highway improvements, together with defending claims under Part 1 of the Land Compensation Act 1973.
  • G E Capital – Business relocation in Sheffield
  • Joseph Holt Ltd - Advising in respect of the Compulsory Purchase of a trading public house and negotiating a compensation claim for this, together with the retail and residential investment.
  • Mobberley – Pursuing claims under Part 1 of the Land Compensation Act 1973 against Manchester Airport PLC on behalf of residents close to Runway 2
  • Cleansing Service Group – Compulsory Purchase of potential industrial development land in Cadishead.
